Traveling With CBD Gummies: What You Need To Know

You may be wondering whether or not it’s legal to travel with CBD gummies. The short answer is yes. Generally speaking, you can fly with CBD gummies as long as they contain less than 0.3% tetrahydrocannabinol (THC). The long answer is a bit more complicated, but we’re here to help.

Traveling With CBD Gummies: Is It Legal?

In general, you can travel with CBD gummies in your carry-on or checked bag as long as the gummies are hemp-derived, meaning it contains less than 0.3% THC per the 2018 US Farm Bill. You can also fly with other CBD products, like CBD oil. Just make sure your oil is less than three ounces if you’re taking it in your carry-on.

On TSA’s official website, they state that “Marijuana and certain cannabis-infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law except for products that contain no more than 0.3 percent THC on a dry weight basis or that are approved by FDA.” (See the Agriculture Improvement Act of 2018, Pub. L. 115-334.) 

So, the main thing to be on the lookout for is how much THC is in your CBD product. If you have hemp-derived CBD gummies, they should contain less than 0.3% THC, even if they’re full-spectrum. However, the only way to know for certain (and prove this to TSA if asked) is to check your Certificate of Analysis, or third-party testing results. In this document, there will be a section labeled “cannabinoid profile” or “potency”. Look for “Delta 9-Tetrahydrocannabinol (Delta 9THC)” in the chart and double-check that in the “Results” column the percentage of THC by weight is less than 0.3%.

Also keep in mind that even when traveling within the U.S., many states have some sort of law in place that requires people to be a specific age to purchase and possess CBD. Some states may not have this in place, some may require you to be 18, and others require you to be 21. 

Can You Travel With CBD Gummies Internationally?

Traveling with CBD gummies or other CBD products internationally is a bit more nuanced than traveling within the U.S. Each country has its own laws and regulations surrounding CBD products.

If you really have your heart set on traveling with your CBD gummies internationally, it’s best to do your own research on the laws and regulations for the country you’re planning on visiting as well as any countries you’ll be passing through.

Tips for Traveling With CBD Gummies

When traveling with CBD gummies, there are a few things you’ll want to figure out beforehand, especially if you’re traveling internationally. It might take a bit of research on your end, but it will surely give you peace of mind.

  1. First and foremost, you’ll want to obtain a copy of the Certificate of Analysis for your CBD gummies. You can often find this through a QR code on the packaging or the company’s website. Bring a hard copy of this and put it in your carry-on with the CBD gummies in their original packaging.  You can also put these items together in your checked bag if you don’t plan on taking your gummies until you reach your final destination.

  2. Research the laws and regulations surrounding hemp-derived CBD products for the location you’re departing from, locations you have connecting flights in, as well as your destination.

  4. Consider the country you’re traveling to when bringing CBD products. CBD is banned in a number of countries including Albania, Bolivia, and Venezuela. In Mexico, it’s legal to possess CBD but must contain less than 0.1% THC. Other countries only allow CBD products that contain 0% THC.
